Privacy Policy.

Working draft. This policy is adapted from OKOA Capital's published 2021 Privacy Policy and is provided for design purposes. Final language and the effective date are subject to review by counsel before publication.

Effective: June 2026 (draft) · Applies to okoacapital.com and its accompanying pages

OKOA Capital LLC, a Utah limited liability company, together with its subsidiaries and affiliated companies (collectively, “OKOA,” “we,” or “us”), is committed to protecting your privacy. This Privacy Policy applies to this website and its accompanying pages (together, the “Site”), which provide information about OKOA, its lending platform, and its investment strategies.

This Privacy Policy describes the kinds of information we may gather during your visit to the Site, how we use it, and how we protect it. It applies only to information we collect from, or that you provide through, the Site. It does not apply to information we collect through other means — including information transmitted to us by email, submitted in a loan application or borrower file, or provided in subscription documents in connection with investments in our funds. Investors in OKOA managed funds should refer to the applicable offering materials for the privacy notice that governs those relationships.

By visiting the Site, you consent to our collecting and storing your information as described in this Privacy Policy. Please read it carefully. If you do not agree, please do not use the Site. We may revise this Policy from time to time; changes are posted on this page with an updated date, and your continued use of the Site constitutes acceptance of the changes.

Information we collect

Depending on your use of the Site, we may collect information from you in different respects.

Personally Identifiable Information

Personally Identifiable Information (“PII”) is information that can be used to identify you — including, but not limited to, your name, email address, phone number, and the details you provide in an inquiry or loan request. We consider this information highly confidential. Where you submit information about a financing request, we collect what is necessary to evaluate fit and, where applicable, to underwrite and service a loan.

Cookies and automatically-collected information

We collect certain technical information through automatic means. We use cookies and similar technologies to collect information when you use the Site. Cookies are small text files downloaded to your device when you visit a website, which may include an anonymous identifier, and are returned to the originating domain on later visits. There are session cookies (deleted when you close your browser) and persistent cookies (which remain after the browser is closed).

Information collected this way includes IP address, browser type, content viewed, and similar analytics. These generate aggregate statistics that are not associated with an individualized profile. The Site does not respond to browser “do not track” signals. You can manage or disable cookies in your browser settings; if you disable them, parts of the Site may not function properly.

How we use the information we collect

We collect and use your information to provide and manage the services you request, including to respond to an inquiry or loan request you initiate through the Site. We may periodically contact you with information about our services, legal notices, or other important information. We may use third-party service providers or other organizations that support our business to collect, store, or process information on our behalf. We do not sell your information, and we have not done so.

We may share your information where necessary to:

  • administer and improve the Site and develop new products and services;
  • protect our rights or property, or the safety of our employees or others;
  • comply with any court order or legal process, or respond to a governmental or regulatory request; or
  • transfer information in the event of a merger, transfer of assets, or other organizational restructuring.

International users

We are based in the United States, in the State of Utah, and this Privacy Policy is provided in accordance with applicable U.S. law. If you access the Site from outside the United States, you agree that your use is subject to this Policy and that your personal information may be transferred to, stored, or processed in the United States. Please do not use the Site if that transfer would violate the law of your jurisdiction.

Links to third-party websites

The Site may contain links to other websites. We have no control over, and are not responsible for, the privacy policies or practices of those sites. Any information you disclose to third parties, including any third-party website linked from the Site, is subject to the privacy customs and policies of those third parties.

Information security

We maintain administrative, technical, and physical controls designed to protect your personal information against loss and against unauthorized access, disclosure, alteration, or use. Unfortunately, no data transmission or storage system can be guaranteed to be perfectly secure, so we urge you to use caution when transmitting information over the Internet. If you believe your interaction with us is no longer secure, please notify us immediately.

Your privacy rights

Subject to various state laws and certain limitations, you may have the right to: (i) request access to the PII we hold about you; and (ii) request that we delete it. You may also have the right to request the categories of personal information we have collected, the sources, the purpose for collection, and the third parties (if any) with which we have shared it.

All requests should be made using the contact details below. If you request deletion of your PII, you may no longer be able to access or use certain parts of the Site. We will respond as soon as practicable and may request proof of identity to verify your request. We do not disclose your PII to third parties for those parties' own direct-marketing purposes, and we will not disadvantage you for exercising any of these rights.
